HD Direct TV Receiver Issue

I received a HD Receiver for my birthday this past February 2010. In the fine print it says that this receiver, in order to provide true HD programming, must have a 5 LNB sattelite dish in place.
I have a 3 LNB dish in place - and therefore can only receive a standard receiver signal. Direct TV sent two technicians out to install a 5 LNB dish, however, they wanted to install it on my roof.
When I said no, I opted just to keep the HD receiver and the regular signal as is. Customer Service sent me an email letting me know that regardless of the signal received they are still charging me for HD service.
Naturally I am disputing this charge - and equate it to consumer fraud. Why should they be able to charge me for a service I am not getting?
I've been with Direct TV since 2005 - and I can tell you I've never had this much trouble with them up until this year (and the HD Receiver). I'm taking this issue up the food chain to our State Consumer Complaint - Attorney General's office.
